Hi there could anyone please help with any advise? My disabled daughter is receiving letters from a debt collection firm regarding an unpaid O2 mobile phone contract. She has never had a phone contract with them ever. This goes back to 2014 when she was still living at home with me. She has now moved
to Manchester but the letters are still arriving on her doorstep, she has never signed any contract with them and no direct debit has ever been set up from her bank account for this contract. Action Fraud have been giving her crime numbers for this issue over the last 12 months but now say that they cannot help any further. O2 say the account is in her name at an address somewhere in Stafford but she has never lived in Stafford. Any advise would be greatly appreciated as this is making her ill. She is registered blind & suffers with epilepsy too and I am worried this is having a big impact on her health & it is not her debt.

This is daft, isn't it. O2 is a reputable company, and you just need to get hold of someone high enough up the company to put a stop to this. How to be heard, though? I assume you have made a formal complaint etc?

one way forward is to issue proceedings under the Protection from Harassment Act 1997. That's a daunting task, but I don't see what else you can do if they persist. I suggest writing a letter before action to the registered office of O2, and hopefully someone sensible will look at this, without you actually having to issue proceedings.

The other possibility is publicity. This story is potentially very embarrassing for the company, and it might interest a journalist.

Ok so you have repeatedly given proof of fraud, firstly I would demand to speak to Fraud Prevention and ask them directly what is going on.

Next, does your daughter have any proof of address for the time period? Utility bill/inland revenue letter/letter from a doctor? Send this in and ask for proof of signature (this is the important but) either writing or verbal.

Before I get shot by the Beagles, a verbal signature is normally place of birth, date of birth, mother's maiden name...
All stuff you can prove.

So if the verbal signature say place of birth Swansea,and she was born in Brighton.... Something is drastically wrong
