  • Parking Eye PNC - now CCJ

    I have recently realised, when applying for finance, I have a CCJ in my name. When I contacted Northampton Court they advised me the CCJ was issued from Parking Eye.

    I emailed parking eye to obtain the parking reference, and any other information. They advised the location and date the PCN was issued and the vehicle reg it was issued to. This is regarding an event that occurred in 2016.

    I am unsure on how to go about trying to get this CCJ removed. At first it seemed that the easiest way was to just pay the fine and ask Parking Eye to agree to a consent order. When I have asked this, they have just forwarded my correspondence to DRP, however still asked me to pay using their website.

    I have then received an email from DRP, instructing me to pay the full amount using their website.

    I feel as this is an attempt at a double recovery, which is prohibited in the POFA.

    I do not understand why I am to correspond with DRP when they have no real relation to the claim, the CCJ is in the name of Parking Eye.

    I also am looking for advice on the best path forward from here.

    I have no information in terms of the "evidence" the claimant would have relied on, nor any information regarding how the charge has managed to reach a total of £197.

    Have you moved house between receiving the initial PCN ( if you did received it ) or since the Parking event which might explain why the COurt papers didn't come to your address ?

    It seems you may need to apply to the court to set aside, you have already asked Parking Eye to consent and they've ignored you - so you will need to apply - possibly on the grounds that you didn't receive the original claim as the claimant didn't check the address before issue and that had you received the claim you would have had opportunity to consider your position and either defend or settle the claim.

      I have moved in with my partner and her parents. However hadn't and still haven't updated my records with DVLA. whoops.
      However there is plenty of things that relate me to the new address, and a more recent fine did sent a letter straight to the address in which I am currently living rather than my old address.

      It has always completely slipped my mind to send of my driving license... until now!

        Also, the vehicle was on finance with a small family run business. This then went bankrupt and the car was removed from me as an asset of the company (I had only had it 11 months of a 60 month agreement), although this is a different matter it meant it wouldn't have been possible for me to amend anything on the V5 certificate.

        I have no knowledge of what happened to the vehicle after this.

          So was it removed before or after the parking event?

          Send a SAR to PE asking for all documentation they have on you. Give full name and both addresses.

          Paying the judgment will not remove the marker from the credit reference lists, it will only be marked as paid,

            I understand this, hence why am looking into my set aside options.

            The vehicle was removed after the parking event but before I moved out.

            I have already sent an SAR to PE which was as follows:
            In reference to the above parking charge notice I request the following information so that I may asses my options for getting the corresponding CCJ set aside:
            All photos taken at the time of the event
            All letters sent regarding this PCN
            All data help on this PCN, including data relating to the VRN and driver
            A full copy of the PCN, NTK
            A list of all PCN’s you consider are outstanding against me and/or this VRN


            Unfortunately, PE are not willingly corresponding with me and keep forwarding me to DRP, who I said have also asked for payment through a different site. So within 4 working days I have been told to pay the full amount by 2 different companies using 2 different sites.
            I have told DRP to advise their client to correspond with me directly and I do not wish DRP to contact me again (I don't think they have any real authority).

            I am looking to complete an N244 form now, seeing as parking eye won't comply however am not sure what my chances actually are considering the circumstances regarding changing my own address.
