  • Court claim from an old PCN

    Hello there,

    I'm Jon, I've been looking for some advice on how to proceed with a court claim that dropped through my door yesterday. It turns out that an old parking charge has been passed on to a company called BWlegal, who have registered it as a court claim.

    I will acknowledge the claim today, however will be drawing up a defence against the alleged £250 owed and would be very grateful for some pointers!

    My defence is that the first half hour of parking in the particular car park is free, that I have absolutely no information on this case back from 2016 and that the figure is completely fabricated with no proof of costs owed.

    I would be very grateful for a bit of direction on how to proceed with this.

    So you send a SAR to the parking company requesting all documents relating to you. Did you receive a letter before claim from BWL? If not you can also write to BWL and ask for all documentation they intend to use in this claim.

    What are the particulars of Claim on the form?

    You will find defences both on here and Fightback Forum that you can use as a basis.
