  • Beneficiaries' entitlement to copy of will under Scottish law

    Hello, I am a new member.

    I am listed as a beneficiary of a Scottish will. The solicitors handling the estate have advised me of the bequest - subject to sufficient funds being available. I would like to see a copy of the will (for rather obvious reasons) as I believe I would be entitled under English law. I can't immediately find the answer by online search, so can anyone advise me of my entitlement. So far the solicitors have not been the most communicative, so I would like to know the position before being any more 'forceful' in what I request.

    Hi and welcome

    If confirmation of the will has been granted you should be able to obtain a copy from the local sheriffs Court or Commissary Department, Edinburgh Sheriff Court, 27 Chambers Street, Edinburgh, EH1 1LB.

    In English law only the executors have a right to see the will prior to the grant of probate (after probate anyone can obtain a copy from the probate registry). If probate is not required the will remains a private document and it could in extreme circumstances require a court order to obtain disclosure!

      Thanks DES8 for your advice. I fear confirmation may take a while as I believe there are around 60 named beneficiaries to be tracked down; but as the deceased left no descendants or close relatives, hopefully there will be no contestation. Probably best just to keep an eye on it for the time being.
