  • Hypothetical Question: Consequential Loss Traffic Accident

    I have a hypothetical question which I've been researching.

    Scenario:

    You are driving to work and through no fault of your own, you're involved in a traffic accident (for this scenario lets say it was an unsecured load on a truck came loose).
    As a result of you not turning up to work, the company you work for loses £100,000.

    Can the company who suffered the lose make any claim against the company (or insurance company) who caused the accident (ie in this scenario the company who owns the truck)?

    Just to reiterate this is purely hypothetical.

    Don't really like hypotheticals as they never contain enough detail!!

    Basically the answer is "no, a claim for consequential loss by the employer of the car driver against the truck driver would fail as too remote from the event"

    The company must be poorly structured if one man's absence for one day causes a loss of profit of £100,000.
    If the employee is so important to the company do they not have Key Person Protection
