So i was under investigation for refund fraud, i was arrested but released pending investigation this was 2 months ago, i went no comment in police interview as advised by my solicitor as he said he doesnt think they have enough evidence. they said i did fraudulent refunds on 6 occasions but only have cctv of 2, the total being £1,337 anyway today i receive a letter from retail loss prevention stating i have 21 days to take action on the letter paying a sum of £2,289 i want some advice asap on this please. I will also be seeking advice from my solicitor and citizen advice bureau next week but any advice is greatly appreciated intol then. Thanks in advance x

They said £1,337 amount was for refund fraud and £800 odd amount was for there investigations cctv paperwork etc.. i did have a browse through at other similiar posts but just wanted to see what best advice you lot would give me in this situation x

So you were an employee and following an investigation you were questioned by the Police for refund fraud. Do you know whether you are being charged or what's happening with that ?
RLP will be acting on behalf of your employer. Only your employer could take legal action against you to recover the money. It's not as clear cut as with shoplifting cases as there will be attributable investigation costs etc as well as the money taken - however it is still down to your employer to take action for recovery of their losses through your alleged actions so you should ignore RLP and only deal with your (ex??) employer.
Mot would be a civil claim to recover the losses. So a county court judgment not a criminal record - the criminal side sits with the police.#staysafestayhome

Oh if you can post a copy of the letter from RLP ( remove your employers and your details first ) it would help see if it is something that warrants action.#staysafestayhome

Okay. RLP can't bring a claim - they might try but you have no liabililty to them at all, only your employer. Personally I would wait until you hear from your employer whether they actually intend to bring a claim ( or issue court papers ).
Has your Solicitor said what happens next with the Police side of things ?#staysafestayhome

No im going to call them this week, since being released from custody cells 2 months ago ive heard nothing all my solicitors said is that the police in my area are very sloppy and dont rush with investigations as not enough resources due to cut backs etc.. so im still under investigation when i was released the sargent advised me id receive a letter with the next course of action but ive heard nothing.

I said i wouldnt be coming back after being accused of this as wouldnt want to work for the company anymore so never turned up for disciplinary meeting then got a letter from them saying dismissed due to gross misconduct that was all. They paid me what was owed to me but not heard anything else from them i thought it would just be dealt with by the police now, also the loss prevention guy did say something about they would get the money back via civil proceedings so im guessing thats the letter i was sent by RLP.

Was there not a case on this forum some time ago with employer/employee were the employer accused the employee of fraud and after a lot of bluff and bluster by RLP, with dire threats of the consequences, it all just finally died a death and nothing more happened?
