Old ccj

Hi thank you for adding me. I have a problem with old ccj please advise me

Can any one help. I had a ccj 2008. I did not know about this. I have moved around a lot. I have just starting recieving letters from link about the debt from mnba. I wrote to them to sb the debt and was then told they had a ccj for it in 2008. Its no longer on my file. Ive spoken to link told them i had no idea of this. They said it was my fault for not updating address. They had the case number on the letter. If they take this back to court will they inform me of court date. Any advice would be appreciated. Thanks.

They will have to apply to the court for permission to enforce the judgment - after 6 years.... and will have to show good reason why they failed to enforce previously.

Limitations Act 1980 24Time limit for actions to enforce judgments.

(1)An action shall not be brought upon any judgment after the expiration of six years from the date on which the judgment became enforceable.

(2)No arrears of interest in respect of any judgment debt shall be recovered after the expiration of six years from the date on which the interest became due.
