    Hi everyone - I am going through the small claims court process as someone is refusing to return my deposit in respect of a horse. The defendant has filed a defence and I have been sent the N180. I have the following questions:

    - The notice states that I should file the N180 with the court office and serve copies on all other parties. Does this mean that I have to post a copy to the defendant also?
    - I have a letter from the vet stating that he discussed the horse's medical history with me (he does not opine on the history within this letter, it is merely confirming that he discussed it with me (during these discussions he made it very clear that he would not recommend proceeding with the purchase)). Where the form asks "are you asking for the court's permission to use the written evidence of an expert?" do I answer yes or no? As above the letter does not provide details, it merely confirms that he had discussions with me.
    - If I am open to mediation, do I send the EX730 with the N180?

    Thanks in advance and apologies for asking what may be very simple questions!

    Yes post a copy to the Defendant as well as returning to the court.

    Expert - that would be a No You will be including the letter in your later witness statement to, presumably, back up that you discussed with a Vet. Only if the Vet inspected the horse and made a report on such with regards the current proceedings. It sounds he's simply confirming your conversation.

    The EX730 is information only, so no, you'd just tick the box on the N180 ( box A1 ) confirming you are open to Mediation.
