    Hello. I would like to know who inherits when one of the beneficiaries of a will dies. Is it:
    - nobody - the estate is divided between the remaining beneficiaries
    ​​​​​​- the dead beneficiary’s issue
    - the dead beneficiary’s spouse (who is not the parent of the dead beneficiary’s children)
    There is no provision in the Will for this scenario.

    Did the beneficiary die before the testator or after? If after, how long after ?

    Are you sure there's no provision at all ? ( sometimes these things are worded terribly )

    Is the dead beneficiary a child of the testator ?

    Was it a specific legacy or a share of the residual estate ?

    If the beneficiary was a child of the testator, then the legacy will go direct to the deceased beneficiaries children ( http://www.legislation.gov.uk/ukpga/.../26/section/33)
