  • What to do next regarding a default.

    Checking my credit file recently, a default has appeared from SLL Capital, for £582. I have no recollection of this debt, so asked SLL for some details (using a prove it letter template from this site). They responded by sending me a generic, undated 'terms and conditions' print out, on non-letter headed paper, with my name and address typed on.
    This told me nothing !!
    I have wrote back asking them to provide me with a dated, signed contract, and any details of where, when and how I applied for the alleged debt.
    That was 2 months ago, and I have heard nothing, however the default is still there on my credit file.
    In all my correspondence I have totally refuted the alleged debt.
    What should I do next?
    Any ideas will be welcome.

    Is the creditors name on the agreement ( terms ) ?

    SLL are debt purchasers so they'll only have limited info so you'll want to look at the original creditor if you need more info about the debt. SLL seem to deal in payday type loans.

      Hi Amethst. In the covering letter they mention the debt was assigned to them by V7?. I've looked this up and it's a payday loan company Vivus, but I have never had a loan from them or any other payday loan co.

        Vivus haven't been authorised since 2016 and V7 Ltd were dissolved in July 2018. Up to May 2015 they were called 4Finance Ltd.

        So SLL Capital bought the ''debt'' and have sent you a couple letters, you've requested more information ( was there a formal CCA request made? ) and they've sent some generic terms which could be anyones for anything - no actual agreement with details of the amount borrowed etc ? Actually maybe you can do a picture of what they sent you - does it have any company / trading name on there ? any date ?

        Did your credit file have anything on it before SLL started reporting? does it have a default date showing?

        You can put in a dispute on your credit file, but of course if SLL are failing to respond to you, but do respond to the credit ref agency to confirm the debt you're back to square one.

        I think you'll have to put in a formal complaint with SLL stating that this is not your debt, and you expect them to provide the full agreement, transactions, and communications, default notice, notice of assignment, and if they can't do that, they remove their entry on your credit file. Then, if they do nothing after 8 weeks you can take it to the Financial Ombudsman and the ICO.

        You could also send a SAR to SLL. I don't think theres any point SARing V7/Vivus as they're kerputt.

        Vivus actually don't mention SLL in their info on their site for customers.... so I wonder if this really was V7.

        so you could SAR Merligen and Motormile… though I'd start with SLL - SLL trade as SafeLoans as well. But if you've never had a PDL you've never had a PDL
