My Scottish law is really not very good (sorry our site mainly deals with English and Welsh law) but I have done some research.

Was the fine you paid made as a result of an offer by the procurator fiscal to have an alleged offence dealt with outside of court and without getting a criminal conviction?

If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.

Yes it was a fine and was dealt with outside of court and to save me getting a crimson record, but I have read on the paper that it states that this will come up on a enhanced disclosure check so I’m guessing the SSSC will see this.

From what I can see it would not count as a conviction and therefore it is not a criminal conviction.

I have found a guidance document: http://www.sssc.uk.com/about-the-sss...r-registration. Section 4 deals with convictions and from what I can see you would not need to declare as your fiscal fine is not deemed to be a criminal conviction. However I would suggest that you go through this section very carefully and also follow the links that is contains to other documents to make very sure.

It may also be worth phoning the Scottish Social Services Council http://www.sssc.uk.com/contact-us and you can always see if you can speak to someone, you do not need to give your name and ask it if needs to be declared on your application and whether it will have any affect on it.

        Hope this helps.
