  • Continue to Insure a PCP car after Voluntary Termination?

    Hi, I'm a Newbie and would appreciate any advice. I have reviewed the current posts but cant find an answer:

    1. I have notified Santander of Voluntary Termination of a PCP vehicle as of today using one of the templates from legalbeagles. I haven't had a response from Santander [though I do have proof the notice was received by them last week]. I intend to transfer my car insurance to a new car as of midnight tonight - do I need to continue to insure the VT car after today?
    2. If Santander don't respond do I need to complete a SORN declaration for the car, ie am I still liable for it in terms of parking it on the public highway, road tax etc?
    3. When Santander do collect the car do I need to notify DVLA that they are the new registered keeper as I would if I sold the car?

    You can transfer the V5 to them otherwise you will have to SORN, the are already the keepers has you have handed the car back. To protect yourself there needs to be some insurance in place just in case the car gets damaged while you are looking after it for them.

      ..and if you are the last person to park it anywhere (public or private) and it causes injury or damage to property (handbrake fails for example) you might be held liable so it is worth keeping third party insurance in force

        Great. Thanks for your help.

        I ended up calling them as I've had no response from my letter. They have told me I have no liability and they have cancelled my direct debit, which is great, but they want to charge me £70 for collection. I've seen other posts about Santander and collection charges. The agreement does state a collection charge but is poorly drafted so if I wanted to be awkward could just say they aren't entitled to a collection charge. I know the CCA doesn't include collection charges.
        Could they mark my credit file with a default of I don't pay the collection charge?
