    Hi my wife has had a County Court Claim for a charge notice from Vehicle Control Services Sheffield that wasn't paid.
    Weve read many forums where people say don't pay them if theyre private car parks etc and it should go away.
    My wife wasn't driving the car although the car is registered in her name but she uses another vehicle.
    I was under the impression that the charge was against the driver and they had to prove who was driving?
    Any advice would be greatly appreciated as this is the last day to challenge the decision.

    Under schedule 4 of the Protection of Freedoms Act 2012 then if they don't know the identity of the driver then they can claim the charges from the keeper of the vehicle. So ignore has not been sensible advice since 2012.

    The have to jump through a lot of hoops to be able to claim keeper liability and they do fail. If it was Scotland or NI POFA does not apply. If it ws on land subject ot Byelaws it does not apply. Similarly if it is land owned by a council and if it is the subject of a Parking Places Order then it does not apply.


    What do you mean by last day to challenge the decision?

    I presume you have received a claim notice from Northampton. You need to Acknowledge the claim, online using the details and password on the form, within 14 days. Do not put anything into the defence. This gives you 33 days from the date of issue to get the defence into the court
