    When dealing with your complaint to the FOS did you get a Subject Access Request from Idem at all ? Might be worth doing as well if not ( they should hold all the records from Button/Picture as it was sold on to them ). http://legalbeagles.info/library/gui...ccess-request/

      I know the loan went from button to webb resolution's before idem bought the loan in 2011.i will sort all this out tomorrow. ill apply for SAR tomorrow also

        Idem will need to evidence legal assignment through from Button to Picture ((( although not entirely sure how they worked, Button were a broker associated with Picture but appear to have lent the money in their own right... it'll come out in the wash anyway))) to Webb to Idem as well to enforce anything... there's lots of issues with these debts and it gets really complex ( probably why the FOS is taking so long ). IF you do get a settlement out of them, make sure you don't sign away your right to any future claims against the company/account - IF there was a breach for 9 years re 77(2) that'd be a shedload of interest that'd more than cover any outstanding debt I expect.

          I did check the land registry and idem have put second charge on my property. which they say they want 150 to remove it in settlement figure I received also on my credit file I have balance of 18029 but they want 18300 im at a loss to it all they include 150 removal of fees and land registry.

            The FOS have your complaint over this - and presumably know you want to get it settled and off your property so you can sell ? What was the last you heard from the FOS ? Have they given any update on how long the adjudication might take?

              Hi
              yes I heard from them 3 weeks ago. They said it's with the senior complaints team. They are looking at end of September. No time scale still. They also said I can sell and keep complaint open.

                    I've had cca. Transactions on copy go back to when it was first opened. With button. Does state it transferred to Webb or idem. Makes it look like it's been with idem since the start in 2007.

                        Update... rung idem. They declined my 10k offer. But are open to offers. I owe 17,989. I just offered 11,500 as a settlement. We shall see.

                            I never mentioned closing the complaint on this proposed settlement.
                            the reason they turned me down was they say I have enough equity in my house...
                            and they said theyd leave it to fos in letter… but when I rung they said they are open to offers. maybe its because they saw my email regarding statement legislation

                              Have you had any update from FOS ?

                              Also - is the property you want to sell in your sole name ? The loan was in your sole name wasn't it, so the charge is ? So if the house is joint owned, it would only be a restriction rather than a charge and you should be able to sell, take the charge to your new property if necessary ( though it could just turn back into an unsecured debt - it wouldn't be automatically paid from the equity ) and await the outcome of the FOS adjudication.

                                It was a joint loan. And new property is joint.
                                so when we sell does it not get paid automatically? Can it go to unsecured to new one?
