i wonder if if anyone can help with a letter of claim and court papers for CCJ.
I originally received a letter from Parking Solution Ltd stating that I had incurred a fine for parking on private land. I requested photographic evidence to substantiate their claims.
nothing was ever received except more letters.
i understand what a letter of claim is, this came from Gladstone Solicitors - they have never provided any documentation that they were acting for PS Ltd.
The questions I have are:
1) Should Gladstones have provided an authority to prove they were acting, the letter of claim just told me to pay them direct.
2) The letter of claim did not fulfill all the requirements under the pre-action protocol. It failed to disclose the following:
a) Whether interest or other charges are continuin
b) Whether the debt was assigned
c) Failed to enclose a copy of the information sheet and reply form (as per annex 1 of PAP), they had a paragraph saying that you can write to them for a copy
d) Failed to enclose a financial statement form
Are their any grounds to get their proceedings thrown out or ‘stayed’ on the grounds they have not complied with the PAP in its entirety and within the spirit of the protocol.
