  • Loan company contacting work and family - my rights/ harrassment or legal?

    Hi,

    I have been reviewing 3 old loans I took out in 2013/14. I originally took out 2k, then 8 months later topped it up to 5k, then 6 months later topped it up to 7k. The interest rate as hiked up to over 90% for the last loan so in total I owed with interest over 20k. I struggled to repay the monthly payments, got very stressed, cut off all contact and the loan went into default, to a DCA and then I paid it off eventually.

    I would like advice on the following:

    During the time went I went into a 'hole' I received text messages all hours, 8/9pm saying I was in trouble - which I think constitutes harressment. However, I do not have copies of these but my mobile provider may still have.

    But what I am feeling I need advice on is this:

    I asked for a copy of my file - and the loan provider (not a high street loan, a bad credit provider), sent me 6 pages of notes in which they log how they contacted my father again and again from Oct 2013 - March 2015 asking him where i was, I had provided him as a contact name. Can they do this?

    They gave the company names which had loans in the title so it was obvious I was in debt, then they kept calling him, texting him.

    Also they traced me to an old job where I no longer worked and had not given them permission to contact - are they able to do this, call/email etc? They contacted my brother who i did not give permission to talk to - not sure how, possibly my father may have given a number - their notes say how my father is worried. It was obvious this was causing him stress. I am so appalled at this. Perhaps it is legal but i wanted advice to know if this is or is not.

    They called him on 3rd Nov, 10th Nov, 21st Nov. 23rd Nov, 15th Nov next year my brother, then my landlord, 28th Nov my father, and my landlord, my father again on 13th Dec & 18th jan, they conducted a skip trace and found an old emplyer, and contacted 9 times in 2 months.

    Is this legal or is this illegal/ harrassement/ any thing else?

    Have you asked then in writing to stop calling and only contact you via mail?

      I didnt at the time as was not aware of it - the loan is now closed. But i requested all info on my file. And saw this log of contacts.

        As this is historic ( up to 2015? ) I doubt it's necessary to ask them to cease contact now. If you gave your father as a contact then you were giving them permission to contact him regarding your loan, on what basis that contact was given you'd need to check the terms of the original loan - do you have those?

        Did the increases start a new loan or rollover the original - was any of the additional borrowing take to pay off arrears on the previous loan ? You could look into affordability complaints and include the data protection issues ( disclosing reasons for calls / amounts etc to your brother/landlord/workplace etc ) within that complaint with a view to escalating to the ICO. Do you have copies of the loan agreement/s and terms ? as first step is to check why you gave your fathers details and what they were allowed to do with that information.

          hi

          I am putting in an affordability/ irressponsibility complaint - first loan took out was to help pay off a pay day loan - this is logged by the company on their notes. then each loan after was for different reasons, but each new loan consolidated the last loan.

            Thank you for your answers is what I should have first said! So, Do you have copies of the loan agreement/s and terms ? Yes, bit in this is nothing on contacting my father - they have not sent this over: should i ask for this directly - they have sent over my file which is 80 pages but this third party contact is not lsited/ incldued.
