  • Council Tax Debt

    Hello All,

    This is my first post.

    My partner got a letter out of the blue regarding outstanding council Tax from June 2011 So over 7 years ago. Its come via a debt collection agency. My question is do the council have to prove this payment was missed. It was around the time she sold her house. We will call them to ask about this. As its the first we have heard about it we will call the local council to ask about this.

    As long as the Liability Order was obtained within 6 years of it being due then it is never Statute Barred and can be chased for payment. You mention Debt Collectors but are you sure this is not an Enforcement Co?

      It could be a debt collector but it's unusual for a council to do so as enforcement agents have the legal power that debt collectors don't.

      The liability order is the confirmation from the court that they are happy that the money is due - a dispute over liability periods isn't something that the court have get involved in anyway as that argument is within the remit of a valuation tribunal. If you look around there is plenty of information regarding disputing liability orders and what issues fall under the valuation tribunal's remit.

      It's very common for queries with charges around the time of house sales due to the changes that occur, most are easily solved.
