    Hi this is my first post , firstly saying hello

    the main reason is I have received a ultra aggressive letter and email from TM Legal services .

    On the 19th of July , I received a email from them , threatening me with a attachment of earning order , their email does not state, who they act for or what this money is related to .On the 20th a letter was received from them now threatening a bailiff visit and again this letter dies not state anything , initially I thought this was a scam , I have done some digging and found out and TM Legal services are Assest Collections and investigations , I am wondering if any one has had anything to do with them ??
    seems the company is owned by the Mollart family ( John & June ,Alex and Caroline Sarah ( Wright )with Natalie Wellington .Natalie WELLINGTON son works there as well Ethan Wellington as guessing they are a nasty vile bunch of people.. Their office at Thompson road , has the signage of CLEAR ( another company within their group ) instead of TM Legal services .Nataie Wellington is their operations director , she and a few others seemed to have come from Welcome finance .Craig Hinchcliffe seems to be their debt buyer .

    A few years ago , prior to becoming serious sick , as in a coma I must of applied for a pay day loan although I can't really remember , I was in hospital for a year and as a result no income as such . Generally most loans got written off because I was more or less dead , now out of the blue these slugs have arrived . Any advise more than welcome ( positive advise )

    To add , TM Legal seems to think the address they have is mine but it isn't it's my girlfriend's house and I have never lived there

      Hello and welcome
      So it sounds like they have managed to get a default judgment against you while you were a bit under the weather and are now trying to enforce.
      So first thing is to check your credit file and the judgment register and find out when this judgment was obtained, and which payday loan company it is for.
      Their claims aren't particularly brilliant so you might be looking to apply to suspend the warrant ( IF one exists) and set aside the judgment with a view to defending it.

      They are harsh with their letters, and quite a lot of them are, umm, bollocks. Threatening all sorts of attachment of earnings and warrants etc when in fact they have done nothing since Asset got the Judgment.

      First thing I would do is check if a judgment exists ( register/credit file) then call Northampton County Court Business Centre and ask them if they can send a copy of the claim, judgment and set aside forms ( N244 ) so you can apply to set aside. They might be helpful or they might not depending who answers the phone but you basically want to check IF there is a judgment and when it was obtained, and IF they have applied for warrant of control or AoE etc.

      Once you've got the info and decide whether to apply to set aside you can look at what your defence might be ( do you know if the PDL or Asset were informed of your situation health wise ?)

        Are you linked on your credit file to your girlfriend? ( any joint loan/agreement with her etc ? ) Set up a phone contract at her address in your name etc?
        Has she ever received any post for you from this bunch ?

          Yes , she has just started receiving post from them although there is nothing to connect us as together ,I never moved into her house as I have my own but tm legal seems to think it knows better than us

            Of course they do

            Regarding the previous post though ( http://legalbeagles.info/forums/foru...30#post1416030 ) Give Northampton CCBC a call tomorrow and see if they have the claim and judgment on their system and ask them for the forms to set aside - then let me know what they say xx

              Tm Legal likes to think it can bully people in it's threats , in the space of one week , yes one week had the threat of bailiffs calling , a attachment of earning order and now today another threatening email another attachment of earnings application . Isn't this bordering on harassment .?
              I did email them initially but they simply have ignored it .

                  Letters like attached and emails like this ( by any chance ? )

                  ( just as examples - they do the same to everyone and people have made complaints to the FCA so you should do the same once your CCJ is sorted out )

                  Email 28 September 2017
                  Following our recent letter, you have failed to contact the office to set up a repayment on your County Court Judgment. We are now in the process of contacting your employer to verify your status of employment.

                  Once we have confirmed the status of your employment, we will complete an N337 Form (Request for Attachment of Earnings Order) and present this to the court. We anticipate this form will be completed in the next few days.

                  After this form has been completed and sent to the courts, we are unable to retract the application and your employer may be informed of your County Court Judgment. Once the Attachment of Earnings has been applied for, the courts will issue you an N56 Form (Form for Replying to an Attachment of Earnings Application Statement of Means).

                  You must fill in this form, giving details of your financial circumstances. These include your employer's details. You are required to include your partner’s financial circumstances also. You must return this to the court within eight days.



                  Email 6th October
                  We will shortly request that this is transferred to your local court for enforcement action against you. We intend to enforce this Judgment against you by way of an Attachment of Earnings Order which means your employer could be ordered to deduct money from your earnings to pay off the outstanding County Court Judgment.

                  This application will add £110.00 of Court Fees to the Judgment amount outstanding. In attempt to try a....
