    Right, im a bit puzzled my girlfreind has sent a letter to barclays finance asking for voluntary termination from 17.07.18 she received forms yesterday one asking to be signed regarding voluntary termination and sending the car to auction or be charged 150 to get collected the other is a form that needs yes no answers regarding the car wear and tear mileage etc .

    she phoned them yesterday the person said if you dont sign they wont accept voluntary termination. on many forums it said not to sign as your signing for charges .i want to no does she sign them or not and when can she cancel direct debit .

    i posted the letter last tuesday they said they havent received it yet yes also sent an email with the letter yesterday to customerrelations@barclays-loans.com.

    Hi Mitman,

    It would seem strange that if Barclays never received your girlfriend's letter then why did they post out the voluntary termination forms?

    Barclays seem to have a habit of trying to pressure people by saying they won't accept the VT unless you sign but I'm afraid the law says that they cannot refuse or reject the termination unless the agreement was terminated by them first.

    Whether she signs the paperwork is entirely her choice but if she doesn't then she could be in it for the long haul. I tend to say that you should oppose signing their paperwork because legally speaking your girlfriend has no obligation to do that, nor is your girlfriend obliged to pay any collection fee because her liability is capped at 50%.

    If she has validly send the letter (my view is there is a presumption since they sent the paperwork so keep hold of that) then she does not have to do anything else. She will be in possession of the car but she can either take it to auction or insist that they collect it or give them notice to collect and sell the car herself if they don't (all proceeds less expenses are to be returned to Barclays).

    I would also suggest your girlfriend put in a formal complaint to barclays
