  • PCP voluntary termination

    Hi, I have followed all advice to terminate my agreement but finance company won’t budge. They are insisting I pay collection fees or take the vehicle hundreds of miles from my home address. After many emails back and forwards, I finally advised of my notice of intention to sell goods under TORTS. They replied by saying that it is my responsibility to return vehicle to them, the Consumer Credit Act does not state the finance company must make arrangements to collect the vehicle, and that as I have a PCP agreement for me to sell the vehicle goes against my right to voluntarily terminate. They then go on to say that if I do sell the vehicle I will need to pay the full settlement figure. Finally they say that under the agreement I signed, I am solely responsible for safe keeping of vehicle and if I fail to return it within a reasonable time of being requested to do so, they can obtain a Court Order for repossession and that I will be responsible for their costs.
    It would seem that this is an uphill struggle that I can’t win!

    Can you post up the chain of emails with any personal info redacted so I can see exactly what has been said?

    Also would be helpful to know who the finance company is.
