  • Reconsidering the estoppel process

    Hi, second post of the day but on a different topic.
    we have a range of debts - credit cards and loans. We were paying minimal amounts to all but then went through the 3 letter and estoppel process a few years ago, with some success. However some have ended up with Restons whose aim seems to be to take unsecured debts and secure them on your home. So in retrospect to avoid this happening with the other debts at the point they become stature barred, would it be advisable to resume the minimal payments to the other dcas?

      How long is it since you did the 3 letter process stuff and ceased payments and communicating with creditors ? I wouldn't just leap in and start paying everyone again after having been through that and beginning your 6 years towards being statute barred. Yes when you are coming up tp the 6 years they might start chasing again but there are stricter pre-action protocols now which you can use so If you start getting court threats from DCA's you can judge each one separately, Get your CCA requests sent off, ask for documents, and if necessary enter into payment arrangements if they proceed after that.

      But I wouldn't leap in and start paying everyone off the back of a threat from Restons...

      What's happened with that ( presumably that's your other thread then … I'll have a look )
