    Hi,
    Thank you for the response, They haven't sent me the other documents i asked for in September, Have only received the letter i attached i have received no other communication from them, my circumstances have not changed since September it's still the same, so should i send them another letter requesting what these other documents are that they hold? or what would you advise as my next step?

          Hi Amethyst,

          Have received on Friday 4th September 2019 the attached information which has taken a year for Link to send to me but they are dated and stamped September 2018 - why are they dated/stamped 2018 - Is this normal or is something not right about this - If you could help it would be much appreciated

                      Thought that might be the case... in which case that agreement isn't a true copy.

                      Have they said when it was entered in to? ( they don't seem to have in the letter or any previous letters that I can see ) That comparethemarket agreement seems to be from 2010 - I don't know if that's the opening agreement or 'varied' agreement though.

                      It was allegedly assigned to Link in 2016. Any idea how long prior to that you were making the token payments to BC ? (ie. when do you think it defaulted? )
                      As an aside, Asset Link Capital (No. 5) Limited have not been authorised by the FCA for consumer credit since 2014. Link financial outsourcing are authorised

                        Hi,

                        I didn't get this card in 2010, they haven't said when it was entered into but i have attached a screenshot of the email i received from Barclaycard which was xx Jan 2014 and i doesn't say anything about compare the market, Any ideas on my next step as i'm sure they will now be more persistent - Thank you

                          Lol, cool, ummm is there an email with the actual original agreement in your email history as well? I am going to remove that email but I've seen it so it's cool, the card was definitely opened in Jan 2014... that would make that agreement mentioning 2010 slightly odd if it was that agreement in 2014. Seems Link don't know when it was opened. The agreement also doesn't mention it was a platinum card.

                          Was the address on the agreement correct in 2010 btw ?

                              Okay Half of me wants to just ignore them and see what they do, but I appreciate you just want to keep the status quo for now until/unless your financial circumstances change.

                              Thank you for the documents which I received on the xxx October 2019. I am a little confused as your letter states that the documents provided fulfil your obligations under the Consumer Credit Act section 78, however the agreement copies provided do not appear to bear any relation to the account in question.

                              Firstly the alleged original agreement is not dated, although appears to be from 2010, and applies to a credit card account opened via comparethemarket.com. I do not believe I entered into any agreement in or around 2010, and certainly have not made any application through comparethemarket.com. The second set of documents is alleged to be the terms as varied. These are also not dated however also do not appear to bear any relation to the account in question. Therefore I refute your contention that the agreement is enforceable. In fact these documents have raised concerns that this account may have been incorrectly attributed to me.

                              I am also awaiting a copy of the notice of assignment from Barclaycard and a copy of the default notice, as well as transactions/statements in order to evidence the amount being claimed.

                              As previously discussed, as I have no intention of trying to avoid any legitimate debts I will continue the token payments I am currently making until such time that these issues with the documentation are resolved when I will be in a position to review the situation further.
