    hi everyone!

    I run a small small family based business and we recently advertised for a part time driver to join us. She had the interview and seemed great then we offered her the opportunity to see what the job would entail. She sat and observed on 2 occasions for a few hours. Although she was not suitable for the role in the end she was not offered the job. She now wants paying for the two occasions she came and observed. WhT is the legal stance on this as she claims she has worked for two shifts without being paid. Although she was just sitting and observing on both occasions. No offer of employment was given.

      If she was clearly observing what the role would be, she was not required to undertake any work, no contract of employment had been entered into, it was for a few number hours and it was made clear this was a trial then no payment is due.

      For info there is currently a Private Members Bill Unpaid Trial Work Periods (Prohibition) Bill 2017-19 the second reading of which was due in the House of Commons on 15 June 2018 but it still has a long way to go.
