We would appreciate if someone provide some legal advice on a bathroom refit. We asked a bathroom fitting company to perform a complete bathroom refurbishment on our main bathroom.
When we were discussing bathroom options in which our original request was to have an electric power shower. The salesman recommended applying a mechanical shower pump rather than the electrical option which we took as a valid and viable choice. At this point the salesman did not highlight any noise/sound comparison between a mechanical shower pump and electric shower.
The pump was fitted on (proper date removed). The first time we used the shower with the pump was on the following day which was not in the presence of any member of the bathroom fitting company. We found the level of noise of the pump to be totally unacceptable. After viewing the guide book the sound level stated was below 70 db. (A) equating to a “conversation voice at 1 metres away” which is not the case.
We asked the salesman to listen to the noise and he stated this was normal but we explained the sound was louder than expected and advised. We explained our original request was to have an electrical power shower and if the mechanical pump to be applied would require the same level of noise. Due to the level of noise from the pump early morning shower namely between 1:00am – 4:00am cannot happen due to the high probability of waking up the rest of the household. When I challenge the salesman and asked if his wife be happy with this sound and he replied “You have got a point” which was quite an interesting response.
The salesman advised he was going think of some options to reduce the level of noise.
Can you advise on the legal position is if the proposals are not acceptable?
