Hi all,
I'm new to this site so apologies if this is something that has already been covered - but I have searched this site for it and can't find anything specific to where I seek advice.
In November 2017 I was notified by a colleague that my personal mental health information had been disclosed by my previous line manager, I was on long term sick leave when the actual conversation took place between the 3rd parties. She had approached him as her new Team Leader about her own M.H issues and this is where both my name and information was given in relation to my colleagues ongoing issues.
I notified the company that I work for that i believed there had been a breach in confidentiality and was asked to submit this through a formal grievance (which I already intended to do) upon doing this I requested that the head of the department did not conduct the hearing as I had made several complaints about my ex manager to her before and she ignored each and every complaint by telling me just to get over it.
Despite this the grievance was still conducted by said line manager and in my recent appeal outcome, I've been notified that the company believe her to of been impartial (when evidence states otherwise) and that I no longer have any routes to take this further.
I would also like to point out that in the original outcome letter the BoC was upheld and then in the appeal they retracted that decision, due to the "impartial" manager being 'persuaded by the statement given by the ex manager to prove that no information was ever given out. There are written witness statements that back my grievance up -
If anybody can give me some solid legal advice on what to do next, I'd be immensely grateful.
Thanks
