    His went to a car dealership on Sunday and put a deposit down on a new car they had on their system signed and went away ,got a phone call yesterday saying that they had sold that car and cannot supply me alike car do we have a legal contract and where do I stand!

    I would say yes you have a binding contract, did you sign any financial paperwork or were you buying it outright?

    You won't be able to get the exact car but as there is a breach of contract, you would be entitled to be put in the position had the contract been performed. So in other words, if they cannot supply you a car similar to what you agreed then you can look for one yourself and claim the difference. If you signed up to a financial agreement you need to notify the lender immediately because it will be the lender that you need to claim against, not the dealer. If you were looking to purchase outright then its the dealer.
