I received a notice of prosecution (NIP) for speed camera offence (38 in 30 zone) from Carlisle Constabulary traffic enforcement 3 months after the date of the offence.
I did not receive any photograph with the NIP
I completed the NIP and asked for the photograph to be sent – they did this with information about ways to deal with the offence
I noticed that they should have informed me within 14 days, but this was 3 months later. I called them and they said that they used info from DVLA which provided former keeper details, and the delay had been due to them being able to trace me as current owner
I have had the car for 3 years, without issue, and Carlisle Constabulary traffic enforcement are unwilling to provide any proof that the delay was due to DVLA issue due to Data Protection issues
What is my legal position to dispute NIP?
