  • CCJ - PARKING EYE - Can I Set Aside -

    This is a complex case, in a nutshell can you apply for a 'set aside' if claim form had been received?

    Unfortunately stupidly listened to advice to ignore all paperwork from Parking Eye, claim form' etc. Was told paperwork was illegal and forged so ignored it.

    Applied for a loan as I'm very ill and needed a loan for medical treatment abroad, but shocked to see have CCJ Sept 17, so loan declined. This has also severely effected my husband's business as CCJ in his name due to being registered keeper.
    At the start also appealed to POPLA but unsuccessful, was also advised

    'if matter went to County Court PE would lose as they have to show a full contract as they only have a letter to POPLA signed on behalf of landlord.

    Ignoring a claim form would not be seen as a reasonable reason for a set aside.

    I would go round to that person who told you it was illegal and make sure he knows his "advice" has cost you a lot.

    You could write to PE and ask for an uncontested set aside and you agree to pay the amount of the CCJ and the cost of the application. There are examples of this around.
