    Good Morning? Mine hasn’t been...

    I had two credit cards with the halifax that I reached an agreement with for paying off a while back- and have been paying off that amount for a long time and always on time..

    this is Morning I’ve had two letters from PRA group asking me to contact them and to not pay the halifax anymore

    after reading many reports of the strong arm / guilt tactics they employ - I’m terrified to contact them!

    can anyone advise me with this issue in anyway??

    Also to add this letter said they had contacted me previously ( they had not) and I’ve received no contact from Halifax either!

      It sounds like Halifax have sold your debt on to PRA - Halifax should have sent you a notice of the assignment ?

      Did you have anything in writing from Halifax regarding your arrangement to pay ?

        It seems what you've received this morning is a Notice of Assignment from PRA. You should also receive a "Goodbye" letter from the Halifax.

        An Arrangement to Pay is an informal arrangement with the original creditor which can't be forced on the debt purchaser.

        PRA are litigious (they issue claims a lot) so my advice is to send them a s 77-79 CCA Request for each debt to establish your legal position. It may also send out the signal that they can't automatically assume that the debts are enforceable.

        They are also bound by the FCA Handbook CONC 13.1.6. which says they must inform you if a debt is unenforceable >

        When (what year) did you open both these credit cards and did they have PPI attached?

        How much is the outstanding balance on each account?

          Thanks to both of you for your reply.

          I’d received nothing before these two letters today - however realised earlier Halifax did not have my current address ( so not sure how PRA got mine) I did all my contact with halifax over the phone and thru the app
          ive checked the app and there’s no correspondence there pertaining to this issue.in fact I was in touch with halifax last Nov to arrange a payment scheme for my current account and to close it and even said I’d been paying my cards off with them and nothing was said.

          one card from Nov 2005 - 6495.87
          and the other from Feb 2007 - 5521.31

          but I’ve been paying constantly for at least 3 years?

          really grateful for the advice!!! Just want to be prepared as possible - happy to pay back as have been within my means...just want to get it sorted and fearful of people turning up on my door and scaring my kids.

            In fact I was always making minimum payments or more on the cards from the start it’s only when I had financial issues that I made the arrangement (3years ago) and as said have been paying every month on time.

              No one is going to turn up on your doorstep to scare your kids - that could only ever happen if you ignored letters, ignored a court claim and enforcement notices. So please don't worry about that

              so you have continued with your payments to Halifax and they have sold the debt on to PRA - it will now be a matter of reviewing your previous arrangement with a new one with PRA if you want to try retain the status quo. But you should also send PRA cca request letters

              Have you any idea when the cards were first taken out ?

                Thanks for that really appreciated-I’ve been getting my budgets worked out... I think I took them out in 2005 and 2007
