Hello, newbie here hoping for some help and advice
My husband was made redundant in 2008 and at the time had a BMW on PCP - we could not afford the payments and the BMW was given back to BMW only 18 months into the agreement - they sold the car but said that he owed £7000 still. We had no money to pay it and despite fighting them they took it to court and had the debt secured on our home using a final charging order in 2010. Since then we have been making regular monthly payments to their solicitors Weigtmans in Leeds and have today received a 'Without Prejudice Save costs" letter from them stating we still owe £5422 which they will accept a full and final settlement of £4422 it also goes on to state that if we don't pay this by 18 May they will take further action - can they do this? can they make us sell our house? They agreed to monthly payments which we have made without fail and now they are asking for a lump sum.
The solicitors dealing with this for BMW are very arrogant and ant the final charge hearing the registrar did not even acknowledge anything we had done to try and resolve the debt.
My husband is still very bitter about the way he was treated and says they can whistle for it! We can't afford to pay a lump sum and I feel angry that they are being so heavy handed again and just pleasing themselves.
