Met have issued a PCN, claiming my car had overstayed its welcome at a Virgin Active car park. In fact the vehicle entered the car parking area twice that day, once very briefly in the morning, but left without parking or the driver leaving the car and a second time mid-afternoon, when the vehicle was parked there for around 90 mins.
The photos they had used as "evidence" to prove their alleged point show:-
1. the vehicle "entering site" in the morning (although the photo could be anywhere and I think is actually of the vehicle in the road before it reaches the car park)
2. the vehicle "exiting site" later in the afternoon, although again the photo could be anywhere.
They have clearly conflated the two visits, ignoring the "exiting site" photo they should have timed for a few minutes after the vehicle arrived in the morning and the "entering" photo they should have timed for 90 mins before it left in the afternoon.
On neither occasion did the vehicle stay anywhere near the limit, nor did the combined time exceed the limit.
The driver would like some guidance on the approach to take. Should they simply explain the true circumstances and hope they do the decent thing and check their records for the other photos? Or do they point out to them that their photos are meaningless, since they don't show the vehicle in the car park, but merely at the entrance/exit and there is no evidence that it was actually parked there?
