Marston Holdings Final Notice

I received a fine for having no tv licence last year, my fault, was in the middle of being evicted under a section 20 and forgot to sort it out.
Anyway, I'm not sure how much the fine was as the letter must have came after I was evicted. In August 2017 I received a call from Marston Holdings to demand payment, at that time I was living in a tent with my daughter, I paid what I could which was £200 and explained my situation and was told I needed to pay the rest in 14 day. Obviously I couldn't, not working as I am waiting for heart surgery. The man kept ringing and I offered each time to pay £10 but he wouldn't accept it.
I eventually found a home in October and my partner has moved in with us and I hadn't heard from Marstons umtil today when a letter was posted by hand (they didn't knock) and apparently they are coming to remove goods for auction at 7pm. Is there anything I can do?

We are in a similar position, my partner was also fined due to benefit changes before I met her.. the bailiff aaron is due anytime to collect her goods and won't believe she is waiting for open heart surgery as the letters she has sent him are in her old address, he basically called me a liar. Don't know where to turn

This could now be difficult because of the passage of time. It is a shame you did nothing earlier as now the Court may refuse to deal with you. Obviously you were fined in your absence and the Court will have assumed they could fine you the maximum allowed.

It may still be worth contacting the Court and explain you have only just found out you could have applied to have had the fine reduced to a more manageable level - I assume you are on Benefits? Plus you should notify them of your condition - again I assume you can provide proof of same. You are going to have to contact the Fines Officer or Court Manager to progress this. You also need to contact the Welfare Dept at Marstons and ask your case be put on hold whilst you do this. Pointless speaking to the Bailiff himself as all he wants is payment.

I don't doubt no one turned up as they said they would, they very rarely do. However Magistrate Court fines do carry permission to force entry if needed.

Has she had a Further Steps Notice from the Court prior to this and if so did she respond to it. Is this the first notification you have had about involvement of a Bailiff. Is she still receiving ongoing treatment for her condition?

They didn't turn up. I will write to the court and explain my circumstances. I have my hospital appointment letters for the cardiologist and the surgeon but when I sent a copy of them via text to the bailiff he said it wasn't enough proof.

No letters from the court. This Aaron has phoned her loads of times but wouldn't accept anything but the full payment. Yes she is still on medication for hypertension and depression and waiting for the surgery to go ahead.

They didn't turn up. I will write to the court and explain my circumstances. I have my hospital appointment letters for the cardiologist and the surgeon but when I sent a copy of them via text to the bailiff he said it wasn't enough proof.

Bailiffs are only interested in blue, brown, purple or red pieces of paper that have the Queens head on them. Better known as £5, £10, £20 or £50 notes. They are well known for being obstructive in order to maximise their fees.
