    Hi,

    I have worked for a large company for 2 and a half years and work 3 days per week (due to a disability covered by The Equality Act).

    My contract states that 'holiday entitlement is 22 days per year based on a 5 day week and part time will be pro-rata. In addition to this, an employee is entitled to any statutory holidays which fall on a normal working day'.

    I understand that the minimum statutory requirement for myself should be 5.6 x 3 days which is 16.8 days per year.

    The workplace is closed on weekends and all bank holidays.

    Since starting I have had 13.5 days per year plus any bank holidays that my days of work fell on. This has been all bank holidays except Good Friday as I have worked Monday to Wednesday thus putting me over the legal minimum requirement. The company want to now change my hours to working Wednesday to Friday which will mean only 2 bank holidays will fall on my working days in 2018.

    I have spoken to a colleague who works 3 days per week also but not a Monday and she has only been ever given 13.5 days per year too and obviously not many bank holidays. This doesn't seem right or fair to me but I'm not sure!

    I would like to know for definite what holiday entitlement I should be expecting in the future, given my contract details and with these new hours please if anyone could help? I am asking for outside help for information as I have had a few problems in the past with the management being 'misinformed' when it comes to HR policies, especially with regards to disability and part time working!!

    Try this site to calculate. I got 16.8 days but this includes bank holidays so you may have been getting more than the minimum number of days with 13.5 plus bank holidays. With not normally working back holidays (apart from Good Friday) you should now be getting more days off. Your colleague should be taking up that only 13.5 days per year with the management.

    Point your management to the .gov.uk page I referenced. Employers quire often get their holiday responsibilities wrong.

      16.8 is what I get too so know I should expect that as a minimum.

      The part that I'm unsure of is whether I should be getting days off in lieu as I am not getting the bank holidays off as I was previously. Also, as FT workers get the bank holidays off, should I be entitled to them or is that covered in the part of the contract stating 'In addition to this, an employee is entitled to any statutory holidays which fall on a normal working day'. Just wanted a broad opinion of what I should be getting given the circumstances and the contract before next week when the holidays are given out.
