Can anyone explain what happens when you go to probate court. I am going to complete and send in a N20 form to the court asking the other executor of my father's estate to produce the accounts. I believe some money may have been inadvertently subsumed into the estate of a personal representative who had the estate money in one of her own personal accounts and she has since died. I have asked the other remaining executor who has taken over all the paperwork to meet and discuss this but she considers the matter is closed and will not talk to me. hence I feel the only way forward is to ask the court to intervene.
I am a beneficiary but the other executor is not. The executor who passed away was also a beneficiary and it is her daughter who is the other executor.
at court am I expected to put forward my case or does the defendant have to answer to the judge? If I have to give my case can I write it all out and read it as I think I will be rather nervous.
With respect to submitting the form N20, do I summarise my claim on the form and go into detail in a seperate document attaching copies of all my letter to the other executor?
i have been unable to get through to the London Probate court to ask for their help and whether or not there is a booklet that sets out the procedures (that is in plain language and not legalize).
