I'm in a sticky situation and hoping somebody can help me out.
Last month on the 24th Sept I took out a PCP policy on a new Mercedes, so 30 days ago. I am yet to receive the car as it was still in production and I've been told it will be delivered early November. I took the policy out with a £1,000 deposit where i paid £200 on the day with £800 outstanding to pay when I pick up the car. I have not made any other payments as of yet.
Since then my circumstances have change and I'm not in a position to pay the outstanding £800 and to carry out the policy.
After reading the t&cs, it states the following:
"The customer shall have the right within 28 days of receipt of such notice to cancel the order and obtain reimbursement of any deposit paid but if the customer fails to give such notice the price as varied by the seller's notice shall become the correct price and the customer shall be obliged to pay that price"
I have emailed them today (30 days after signing - 2 days later than what the contract appears to allow for) requesting the order to be cancelled.
Could anyone please shed any light on the situation as to:
- Am I now committed to the PCP policy, or is it possible to cancel it?
- If I can cancel the policy, would I lose my £200 paid already?
- Would I be liable for any other costs?
