    Hi we purchased a car from Arnold Clark 3 weeks ago and the day after we found lots of faults brakes tyres service very poor paint repairs the car was 20000 Miles and 21000 pounds so I wouldn’t say we are being fussy the have gave a final notice saying they will not accept rejection of Car we have took trading standard sadvice and sent letters recorded delivery rejecting the Car etc, we put the Car back with keys and documents last week and they are still not helping at all we have sent over 30 emails they just don’t care can anyone help or has anyone been in a similar position

    Did you mention in your rejection letter the faults and the Consumer rights act?

    What reason di they give for not accepting the rejection?

      Hi yes I did they are saying due to cosmetics the paintwork is shocking lots of scratches and runs in rear bumper and overspray all over the car I should have looked at it more it is a black car and it was raining on purchase , all brake pads are below 2mm and both front tyres worn and no service history, they just do not care

          I would not say the bodywork defects are illegal but the state of the car in lots of parts in the bodywork are shocking for the mileage and price, i would say the brakes and tyres are illegal , they do not look cars over before sales and have no interest in complaints

          Sorry to send this letter to yourself but trading standards have advised me to do it as we feel we have no option due due the difficulty we have been having with one of your sales managers campbell mckay volswagen glasgow and your customer service team also not willing to help whatsover after around 25-30 emails your customer service team have closed this case, we have purchased what should be our dream car and audi a6 2014 with 24000 miles we purchased after a video sent to us and fully trusted your good name as a car dealership well that has turned into a nightmare for us the car just is not fit for purpose and after not being able to resolve this and legal advice we have rejected the car and they will not do anything my wife has called in tears and it is having a little straining impact on our relationship, I did not expect a service like this from yourselves and I am shocked I have been in touch with the smta and the motors obdusman but we know this is not an overnight fix, I would like to see your thoughts on this matter and if your reaction is the same which I highly doubt , I have no alternative but to pursue this through trading standards the smta and the motors obdusmen and djp sollicitors in aberdeen. I will take the car back and put it to aberdeen audi for a full inspection bodywork and mechanical issues , I will fight this through the courts with all of these parties involved and with what I have been told it will be in our favour, this is a last step method and I would like to think it could all be resolved without this, thank you for taking the time to read this. Here is a copy of the email that was sent to yourselves last night

            Hi that is the Car documents and keys dropped of at Aberdeen ford branch for rejection reasons being front inside edge of tyres the service light and no service on digital Audi records all brake pads have a few Mm on them which is dangerous you’d did not inspect the car before the sale I have been advised, also the rear bumper has runs in paintwork from previous poor repair the passenger side rear quarter where you’d removed a dent has marked the paint the rear quarter and door on drivers side has a scuff mark that you’d said would polish out but doesn’t the front wing and bumper paintwork and the various scratches all over the car , these could not be seen on day of sale due to drizzle and being black , also the whole rear of the car and the passenger side has overspray all over it this is unacceptable and you’d have told us we have to accept this, I’m sorry but we are not it is ridiculous paying that for a car from someone as reputable as yourselfs and the car only being 24000 miles to have a list like this is just shocking, Campbell the sales manager called to say get it removed from the Aberdeen branch we have been advised by inverurie trading standards office this is not the case and you have full responsibility for the car as we have rejected the car which we did do two weeks ago.

              So if you claimed through the courts this would not be small claims court, hence cost implications. You do not seem to have pointed them to the Consumer Rights Act 2015 which allows you to reject absolutely within 30 days if the goods are defective, not as described or defective.

                  I have mentioned the consumer act it was paid debit card and finaince the company it’s with is an Arnold Clark company they are no help at all I’m fighting a losing battle

                    Arnold Clark appear to work as intermediaries with a number of finance houses.

                    look at your paperwork to discover the finance house involved and advise them you have rejected the vehicle and require a refund of all monies paid.

                      They are saying it can take 3 Months to look into it they are a joint company I think

                        Have you actually told them, in writing, that you are rejecting ?

                          I think your way forward may be via the card issuer as a chargeneral back. But you must reject the vehicle formally and in writing . Follow the advice given earlier.

                            Yes sorry I thought above explained this we have written to the head office and the director with recorded delivery’s they have received rejecting the car also sent them the same letters by email they have issued a final response and will not accept rejection
