  • Section 21 notice

    I have been told that a copy of the Section 21 notice must be given to each occupant of a property even in the case of a joint tenancy, despite all parties being named on the notice itself. Is it actually a legal requirement for each of those individuals to be given a separate copy?

    No - On the contrary, a section 21 notice containing the names of all joint tenants should be served on just one of them.

    In Hacking v Jones (2012) Croydon County court judgment (unreported) where a landlord served two separate s21 notices addressed individually to each of two named joint tenants, he had not served a valid notice for the purposes of the Housing Act 1988 and was not entitled to possession
