    Iv'e now got the Barclays atatched.

    Although the claimant has edited out his identity and that his claim was made through a claims company the senders ID is there and the letter
    clearly shows that Barclays acknowledge his hardship status but will not consider his claim.

    (Sandra) Hamilton v Natwest

    I have attached the docs plus the email Sandra sent me, they also sent her a financial statement to fill in which we have done and returned, as far as I know, she has had no reply yet (sent 1st Nov).

    The Schedule shows her having a negative budget, I can let you have that later if you wish, Sandra has given me permission to share this info.

    Not yet gone to FOS, awaiting response from the bank.

        Re the Barclays letter in post #1, I came across someone on MSE who received what appears to be an identical letter from Barclays very recently.

        Last year I spoke to the chairman of the Banking Code Standards Board and read the letter to him. Although he wouldn't go as far as saying the letter was proof that Barclays were routinely flouting their obligations, he did say that if the letter turned out to be a standard letter, he would look in to it. As the 2 letters were written some 6 months apart it would suggest that this is Barclays standard response.

        I'll PM the MSE poster and try and get hold of his/her letter and I'll call the BCSB again tomorrow.

        Banking Code Inadvertently misrepresented in the media?
        My bank has just replied to my request for unlawful bank charges insinuating that I cannot claim early if I am a Hardship case.

        See quote below

        'I believe our obligations under the banking code may inadvertently have been misrepresented in the media and elsewhere. I appologise if you have recieved the impression that your financial hardship complaint is an alternative to your bank charges complaint as a method of obtaining refund fees (and consequently avoiding the current deferment arrangements'

        This now appears to me an alternative tack that my bank has taken given that they have sent 2 previous letters that they will look into my case.

        I fully intend to pursue that Hardship claim by filling in their forms but has anyone else experienced this and had a result ?

          Can you ask what the circumstances are that makes her into a hardship case too. Ie. if this is a letter to genuine hardship cases or others.

            I PMed him/her but they haven't logged on for 10 days so it may be a while before I get a response.
