    It may well be worth setting up a 'phone tree' of mobile numbers.

      I confess to feeling somewhat nervous about the out come of Thursday.

      I feel confident that we will achieve the first step towards recognising that these charges ARE unlawful.......but it is so vital that Justice Smith finds that the banks' T&Cs are covered by UTCCR 1999, that Thursday does fill me with a sense of excitement and trepidation.

      I certainly don't believe that the current state of the banking industry will play any part in Justice Smiths decision.

      Dare we even contemplate what would happen if the OFT lost?! The confusion would be unimaginable.

        I'm really hoping to be able to get down for the Judgement on Thursday, should be an interesting day to say the least.

          Just a quick word of warning to anyone reading this thread, or in fact anyone reading anything over the next few days regarding the Test Case.

          Exc will like me remember the words of Megan Murphy at the Brennan Vs Rabinowitz debate recently. She suggested that in the few days leading up to the actual Test Case Judgement and on the day of the actual Judgement itself there are going to be scores of rumours flying around, deliberate leaks, false leaks, gossip, scandal, misunderstandings etc etc.

          Could I suggest that we have a protected thread that official LB news can be posted upon, the thread should only be accessible for posting to nominated LB personal who will be responsible for posting accurate and verifiable news relating to the judgement itself. Ideally, it could be started tomorrow and regularly updated over the next few days leading up to the judgement itself. IE the thread should not just be a normal general discussion thread.

          What does everyone think ???

          I have certain selfish reasons suggesting the above as I will be tied up for most of the day on Thursday but will have internet access and will of course be trying to keep a very close eye on how things develop. I would rather have a dedicated Judgement Day news thread to focus on rather than try and wade through scores of posts on numerous threads.

                    The handing down of judgment will definately be at the Royal Courts of Justice, court No 73. It's scheduled from 10 to 4.15. There are an unspecified number of public and press places in the courtroom and depending on demand, there may be a feed room for overspill but RCJ are unable to confirm it as yet.

                    Prior to Thursday the 'embargoed judgment' is only going to a small number of the legal teams of each party but the banks and OFT themselves are not privy to it and will hear it first hand on Thursday.

                      Don't forget that the handing down of the Judgement on Thursday is likely to only be in relation to the current Terms and Conditions of the Banks and whether they are subject to a test of fairness, as argued by the OFT in accordance with the UTCCR 1999.

                      It is quite likely that any decision or guidance to the County Courts regarding the application of UTCCR 1999 in relation to historic terms and also the penalty charge aspects of unauthorised overdraft charges ( the majority of people's stayed claims are based on historic terms and penalty charge aspects) will probably not be given until a month or so after the initial judgment.


                      This is what Justice Andrew Smith said on the last day of the Test Case ( almost his final words ).

                      "I have already said that the reason I felt it appropriate to deal with the current terms at this stage, and not deal with the historic terms, is because there is every indication that to some extent my findings will translate readily to a significant proportion of the historic terms, and that, while nothing is certain, might well lead to decisions on the historic terms being made in very short order, within a month one would certainly hope ( of the initial judgment )."

                      Neverthless, I am sure we will all be reading into whatever the Judge has decided to hand down on Thursday and surmising the possible outcomes for our own outstanding claims.

                        ''Mr Justice Andrew Smith will, barring any unforeseen circumstances, hand down his judgment in the case of the OFT v Abbey National PLC and others on Thursday 24 April.

                        No information concerning the contents of the judgment will be available prior to it being handed down in court.''
