BBA Statement: "The banks and building society in this case agreed to the present proceedings with the OFT and the FSA. These will provide a ruling on whether charges imposed for providing overdraft services not agreed in advance with the banks are capable of being assessed for fairness under the relevant regulations."
"This is now an issue for the courts to decide. The judge will be considering various points and this will take a period of time, probably some months. We understand the interest, but it’s not time for speculation on detailed questions which the judge needs to consider. Now is the time to leave it entirely to the courts".
