    The OFT is urging shoppers to know their consumer rights when buying clothes for the Christmas party season or in New Year sales.

    A quick question about this for someone in the know please. If you have removed the sales label from the clothes item, are ones rights affected?

      Handy tip re goods bought as gifts - Gift Receipt

      Which? shopping tip

      Make sure you ask for a gift receipt that will allow the recipient to return it to the shop.
      If you can't get a gift receipt, write ''gift for [name]" on the normal receipt, and get the retailer to accept this by signing it. The recipient should then be able to take it back if they need to.

        I'll have a bash.......
        I would say 'not', & would argue that the removal of sales labels should not affect one's rights under the Sale of Goods Act (merchantable quality, fitness of purpose, etc), no matter what the supplier's own policy may stipulate.
        They cannot put a clause in their T & C's which overrules statutory rights, regardless of what Brenda at the checkout may say.
        If the item is a gift, though, & you are the recipient, you don't have a contractual right*, so you may well be stuck with the festive jumper with Santa & his sledge emblazened on it (again!)......unless Brenda takes pity on you, lol.

        *This is where a 'gift receipt' comes in handy. (see above)
