    There is an interesting case OTR that I have contributed to in the past as Varangian3.

    Gertrude was one of the very few people who has succeeded in getting an injunction placed on the bank to prevent further charges being applied, after failing to lift a stay.

    Now, the bank has applied more charges in defiance of the injunction. This is an interesting one and I will update this thread as I hear.

    this is really interesting as to what the defence will be. Can you remember that someone on the general forum otr got an injunction against NatWest about placing a default on their record and it was broken. They blamed human error. Maybe the same excuse??

      Unfortunately this does not really mean a great deal. The sanctions available to a court with which to deal with this are limited and there is no authority in the land with the ability to fine a bank sufficiently to really hurt them.

      It's a game and Barclays are playing it.

        In an interesting development, the court has set a date later this month to hear the lifting of the stay, presumably on the grounds of the bank breaching the court order.

        Sorry I have not been keeping you informed. I have moved house and BT has messed up my phone line so i cant get broadband etc.
        I wrote to the courts as Castlebest suggested as bank charges were being taken out after receiving General from of judgement stating that this should not happen.
        I waited for a reply from the courts. After waiting for a fortnight I rang the courts and they said they had mislaid my file and would let me know when it was found. They found it eventually and I now have a court date for the stay to be lifted on 29th Jan although the court said that by then the test case should have finished. I doubt that very much!!
