    The OFT has today launched a consultation on its draft guidance for creditors on mental capacity.
    The draft guidance is designed to explain the steps the OFT expects creditors to take to identify borrowers who might lack the mental capacity to make informed borrowing decisions, where it isn't known that they lack capacity but there is reason to believe, or at least reasonable grounds to suspect, that this might be the case.
    It also outlines the OFT's view of the appropriate way for creditors to deal with borrowers who do or might lack capacity, and explains the practices and procedures it considers they should put in place.
    Mental capacity is a person's ability to make decisions and depends in part on their ability to learn, remember and understand. For many people, for reasons of illness or disability, their mental capacity can be affected in ways which may prevent them from making certain decisions that may impact on their lives.
    Lack of capacity can be permanent or temporary. Mental Capacity is not the same as mental health, as someone with mental health problems may still have the capacity to be able to make informed decisions.
    In the case of consumer credit, creditors need to form a view on whether the borrower is able, perhaps with support, to make an informed borrowing decision and whether they can afford to make repayments under the credit agreement in a sustainable manner.
    As well as providing clarity for creditors on what the OFT expects of them in these circumstances, the guidance is also intended to help protect vulnerable consumers from taking on unsustainable or unsuitable credit commitments, while at the same time ensuring that they are not inappropriately denied credit. The draft guidance takes account of legislation in this area to the extent that it is relevant.
    Ray Watson, Director of the OFT's Consumer Credit Group, said:
    'There is a clear need to strike a balance between protecting consumers who lack the mental capacity to make informed borrowing decisions and ensuring that they are not inappropriately denied access to credit. It is very important that creditors balance borrowers' rights to make borrowing decisions with their right to safety and protection when they can't make decisions to protect themselves. We look forward to receiving comments from those with knowledge of and an interest in these issues.'

        I agree LB should respond. This is an extremely difficult piece of guidance to put together and could potentially cause enormous problems. There are a myriad of issues that need thinking about.

          Sorry guys, I just didnt get chance to do this one. There is a big section on Mental Health in the OFT 664 consultation debt collection guidance which I think would appreciate some input in this area - all comments and input very welcome.

          We'll keep an eye on the responses to the mental capacity consultation.

            Hi AME, does this apply to future or does it include past mental capacity issues too?

            Hope I explained that OK? I mean will this act or rules n regulations apply to creditors and consumers from now on or will it take in past mental capacity and irresponsible lending issues too?

              I believe it just clarifies the position on the view the OFT will take of actions that go against this guidance, so would be applicable to anything since the irresponsible lending stuff came in in the CCA - sec 25(2)b.

                    I will have a good read of this consultation this evening and help where I can as it does affect me due to the stroke and operation I had.

                    Sapphire yes you are right and this is something I have been trying to devote more time to recently

                    Many people with limited mental capacity also have communication problems too and that one alone can play a big part in consumer debt.
                    If you think nobody cares if you're alive, try missing a couple of payments.

                        A little late on posting on this thread I know but...................

                        I think there should also be some study into how the actions (i.e. harrassment) of creditors towards debtors can also cause mental illness.

                        There are all too often stories of people who have taken their own lives after being hounded mercilessly by debt collecting agencies and made to feel worthless by some of the 'agents' who speak to them.

                        Having gone from a very positive outgoing person to being very withdrawn and not knowing where to turn I will always be eternally grateful to this forum (and also MSE and All-About-Debt) without whom I wouldn't have known where to start to tackle my creditors (other than to scream F.O. down the phone at them every time they called).

                        I am now back to being the positive happy go lucky person I was (although I have my 'scars') and recognise now that I went through an episode of depression that was no doubt caused by the constant harrassment and bullying I was subjected to by my creditors.

                        I am sure that there are others out there who aren't so lucky, and perhaps more vulnerable, who are not being helped by these companies 'collection activities'.

                        While I don't disagree that creditors should have routes to collect debts from 'won't pays' a review of their practices, especially in relation to the above subject, is long overdue.

                          Crispybacon,

                          Glad you are better and have realised that debt is not the be all and end all, debt has also affected me in a mental way having had a stroke which in its self has left many disabling conditions.

                          I also had a heart attack in march 2009 and the stress and anxiety of having to deal with the debt I got into through no fault of my own was partly to blame.

                          Yes I was on medications to keep my blood pressure (hypertension) in check but all this stress pushed the blood pressure over what those meds could deal with.

                          However it has taught me a lesson like you that debt is not the end and there are ways forward.

                          I do agree though that more needs to be done regarding debt and mental illness.

                            I think, to be fair, you have had a hell of a tougher time of it than I have.......

                            Personally I think there are 2 distinct issues here

                            The ability to make 'informed' decisions on taking out credit based upon mental health or mental capacity grounds

                            The affect on mental health/capacity when dealing with debt, and how creditors seek to exploit this
