    Apparently a judge in Bath heard 4 claims yesterday and was appalled that in one case the bank had stopped the DD to pay someones rent. After some deliberation privately, he ordered an injunction to prevent further charges to any of the accounts. :roll:

    As far as I am aware this is only the second case of this happening, with the recent one in Luton.

    One of the good things is that it will be very difficult for the bank to arrange the computer to do different things with the odd account. This is probably one of the few instances where the bank really will incur heavy costs for the service!!

    Excellent stuff, but there doesn't seem to be any pattern to this that can be built on (yet).

    I think that is at least the second judge that has imposed a stay on banks charging people suing them until the outcome of the OFT test case. Interesting thing indeed albeit, very sad that the OFT did not consider this prior to announcing that they were suing the banks.

      Does this mean no charges applied full stop or merely that charges are deferred until after the test case?

      If its the latter, it doesn't really help much.

        I don't think it helps much at all to be honest - if the stay was lifted to allow the claim to proceed surely that would have been of greater benefit to the claimant.

        The injunctions being requested seems to be giving the courts a way out of lifting stays, and could cause huge problems in the future for these claimants - particularly if they are already in genuine financial difficulties due to the charges. JMHO.
