received court letter for ex-partner

    hi

    I received a court letter from PO Box 300 NN1 2TX for ex partner debt dating back to 1998

    I have been returning these letters to Arrow (debt collector referred to on court paperwork) for over a year stating 'person not known at this address' etc. Sometimes enclosing their letter, and putting in writing 'this person does not reside at this address, I do not have a forwarding address'

    is it best to return the court forms, along with letters I have sent to Arrow informing them that ex does not reside with me, and copy into the solicitor mentioned on the court paperwork, again explaining that I have for over a year explained that my ex does not reside here?

          Ok,

          If the claim pack is addressed solely to your ex you should return it to the CC business centre with a covering letter.

          I would be inclined to tell Arrow Global via Formal Complaint that if they continue to send correspondence to your address you will make a complaint of harassment and will also send the details to the FCA.

                No each case is very different.

                One cannot make individual complaints to the FCA however the conduct of a regulated/licensed company can be reported the FCA will log all such reports and if sufficient information is provided it can take action. It's always worth making a report.

                A straight forward " what's happened how and when" will suffice with copies of any " evidence".

                      I see this situation differently from others

                      Firstly, it is a criminal offence to open other people's mail (Postal Service Act 2000) although I doubt you'll find yourself behind bars for doing it. Curiosity is a powerful force, but I would be mortified if my ex-husband opened my letters. Would you have opened the letters if they had been addressed to Mr Mickey Mouse and not your ex?

                      Secondly, I see no harassment. Arrow is writing to your ex not you. Ditto Northampton County Court. Harassment needs to be something done which makes you feel "distressed, humiliated or threatened". How can a letter addressed to someone else do that to you? Especially since the sender would not expect you to (lawfully) open it. Didn't Arrow's letters say "to be opened by the addressee only" on the envelope, because they usually do?

                      I can see it's a faff to keep writing "Gone Away" on an envelope and stuffing it in the post box, but that's hardly harassment.

                      The CAB has a simplistic guide on what to do with mail which isn't for you. It gives you three options (all of them legal) > https://www.citizensadvice.org.uk/co...ne-elses-post/

                      I think the only thing you need to worry about is whether your ex is financially associated with you on Credit Reference Agency files since there's an implication that your ex may have a debt - albeit the case hasn't been tried yet to know if that is true, all that's arrived is the summons.

                      A financial association could be to your detriment if the link has a negative impact on your own credit status. This link to Experian tells you how to get it removed if needed >

                      Writing to the solicitor for the Claimant to tell them anything about the Defendant (your ex) is a definite no-no! Do what the CAB advise and nothing more.

                        Have to disagree.
                        Arrow have been formally informed that the person concerned is not resident at DTSFA 's address yet they persist in sending letters and have now issued a claim.

                        It is the OP's choice if to pass on contact details for the ex if asked, nothing unlawful in doing so.

                        The constant flow of mail after taking action in informing the sender of non residence is harassing, for example when we moved into our current home we received dozens of letter from a debt purchasers seeking 2 individuals once resident here.

                        Having informed the sender and returned items to them they still persisted ( BTW using the return address on debt collectors envelopes is pointless it's just a dead letter office) A formal complaint to the CEO of the offending company resulted in a high 3 figure compensation payment.
                        However I do agree checking for financial/residential links is advisable.

                          What would be your complaint to the FCA?

                          All Arrow has done is send letters to someone who they believe (rightly or wrongly) lives at that address. The fact that you've written and told them different is awkward since you shouldn't have opened their mail in the first place.

                          Arrow may also suspect it's not true if your ex is still on the Electoral Roll or there is other financial information 'live' on their CRA files linking them to the address.

                          Arrow will only listen to what your ex says to them or what a tracing agent advises them.

                              A person commits an offence if, without reasonable excuse, he—

                              (a)
                              intentionally delays or opens a postal packet in the course of its transmission by post, or

                              (b)
                              intentionally opens a mail-bag.
