    Hi
    Will my ex partner be entitled to occupational rent if she as not contributed to the mortgage for 18 months and she left the property via her own free will? My partner gives me money for bills but nothing is in writing

        have tried to follow this all through from the previous thread but it does indeed seem absurd that the ex-partner can insist on 'occupational rent' when in fact that party is there as a guest of the current resident who would have just as much right to ask the same. The only reason that the current resident would ask rent from the new partner is perhaps to prove that the property share is a business proposition and indeed not a 'partnered basis' where that new partner could claim some rights after say two years of sharing costs.

        Anyway the ex partner would have to set up a tenancy agreement, agreed and signed by all parties, and declare it as an income, which is rich if there is no mortgage being paid.

        Simply put, and I agree with others, this is simply the actions of a scorned party with the only object to manipulate.

          I Just read through this and the other thread.

          I am presuming that your Ex is or has been registered at her new property since you split, or anywhere else formally ( this stops her claiming any form of right to occupy )

          Your ( you and your Ex ) both joint owners, but your ( you and partner ) are the occupiers, The ex would need a court order to do anything against your partner, and i cant see how that would be possible anyhow. If your partners contributing financially then its just there share of the bills, its nothing to do with your Ex, she cant demand your partners a tenant, and try and force rent.

          I think as well, if the locks are changed since she left, and she doesn't have access normally or by agreement with you, it could be breaking and entering if your not there.
          Was all of the negative equity down to property drops, or did you borrow further after your mortgagee,
          crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even
