  • In need of advice

    Hi all
    I have recently been dismissed after 3 months of service for gross misconduct I have previously had no dispinarys beforehand. I thought it would be best not hand my notice in as id already been placed as guilty before having the knowledge of the "allegations" are. I was just explained that I had been suspended on full pay untill they was investigation meeting which will decide that I need a disciplinary or not. However I was actually guilty of it and they was quite right to do so. I admitted this in the dispinary hearing and investigation meeting. During my induction programme I found that other staff where doing the same thing as I was dismissed for. And because I was in a care home. I questioned this on many occasions and they said it was fine because the service users understand that you are having a laugh and they like it when you do. The service user did take this as a joke but they was confused because I am normally really professional and it was one general slip up. I have 2 plans for my future look for a job outside of care as I have plenty of experience in a mixture of jobs atay there a while and prove that I am very able to be professional or plan 2 find another job in care explain what happened. ( It said on my dismissal letter I was very regretful of my actions) which is true and i have generally learnt from my mistakes. I have appealed and explained what happened in a more detailed manner and still waiting for reply but my appeal is putting a clear understanding towards them that I don't want to be reinstated just for it to be lessened on my record.     Hi.

    What is it that you need to have advice on?

    Not sure if you realise but they can sack you for pretty much anything until you have two years service.

    From the facts as you describe them, there is little prospect of your appeal succeeding. I am not sure what you are looking for, I know you want something to be lessened on your record, but don't want reinstatement, so essentially either you were or you were not sacked for gross misconduct.

    Am I missing something?

      Weather to apply and get back into the same role elsewhere or look for a different role and yes am aware and I dont want to be reinstated because I do not want to go back as I didn't receive much training at all even through I was promised this knowing that I didn't have much experience in the role

        Sorry, I still don't know what you need advice on?

        If any reference says that you were dismissed for gross misconduct you may well struggle to get over that.

        You were there for a very short period. Do you have a significant work history meaning that you could "forget" to include this employer on your history?

            Are you saying that you were dismissed for gross misconduct that caused harm to a service user?

              Nope it was verbal abuse but wasnt ment in like nastiness or anything and I had a witnesses statements both backing this up. On my dismissal letter it states that I was regretful and they think it would not happen again but I anit sure if they have passed it on or not

                By far the simplest way to find out would be to ask them if they considered the incident sufficiently serious to be obliged to refer you to the DBS. x

                  Yeah they've spoke to safeguarding board at my local council ill ask management tomorrow thank you x

                    I have asked them but they haven't got back to me personally I think it wasn't serious enough to refer to them as they think it was a one off incident so am going to ask my local safeguarding board and see if they have as management have received my message
