Kennel Cough!!

I went shopping about 2 weeks ago leaving my eldest son at home and the two dogs in the back garden. They were safe and secure, with a teenager (age 15) to keep an eye on them. We get back to find both the front and back garden gates WIDE OPEN ... and no dogs anywhere to be seen!!

After 3hrs of searching the streets for the dogs (in the pouring rain) we get a phone call - the dogs have been picked up by the warden and are in the local 'kennels' waiting to be picked up (thank Gods they're both chipped :nod.
So ... the dogs were safe, but needed picking up from the kennels (approx 9 miles away). I don't drive, and there are no busses straight there, so I arranged for my mum to collect them that evening.

Mum gets there (35miles one way from hers') to find out there's a charge to be paid before the dogs are released (not told beforehand) of £25 per dog "mandatory council fine" and £7 per dog for "kennel space" ... she phones me and I do a bank transfer, but the kennels then say they don't take cheques or cards ... it has to be cash . 1/2 hour later (after finding a cash machine in the middle of nowhere) the dogs are released.

We get the dogs back, they're safe, no harm done ...

Poor Fluke is 14-15 yrs old ... he can't deal with it the way a younger dog can

The vets costs will be massive!!

Am I right in asking the kennels for a refund of the £64 (I've already spent more than that on vet fes)?

Yes most certainly especially as they charge for boarding as well.

Am sympathetic but where a dog is "seized" by the local authority or their agent, s149 of the Environmental Protection Act 1990 provides that you must pay all expenses associated with it and Environmental Protection (Stray Dogs) Regs 1992 provides for £25 on top.

I am afraid I don't think the fact they caught Kennel Cough would allow you to escape a statutory charge.

Poor dogs, but although it sounds terrible mostly it's not serious and dogs will actually recover without treatment.
However treatment can alleviate the symptoms and aid recovery for the three to six weeks they are ill.
More worrying is what other infection can be picked up in kennels at the sametime.

Regarding recovery of fees paid I doubt you'll have much luck with the £25 fee (which will be for the collection of the dog and is probably the standard mandatory LA charge),
So you have to consider how much effort its worth investing in trying to recover the total £14 balance

Just shows how really infectious it is they were only gone a few hours, the vaccine is no guarantee either although helps if they do catch it. You can't take a dog in boarding kennels without a cert they have been vaccinated, not so in council kennels sadly as they usually just strays.

you know the stupid thing [MENTION=141]enaid[/MENTION]?? MY two are already innoculated I'm just P$$$$d off that it's costing me more for the medication than it cost for the 'boarding'

Wow - not cheap to lose your dog in Fareham.

The £25 is statutory under the Regs I have already mentioned.

ss5 of s149 provides that:

A person claiming to be the owner of a dog seized under this section shall not be entitled to have the dog returned to him unless he pays all the expenses incurred by reason of its detention and such further amount as is for the time being prescribed.
