  • Use of toilets at a industrial site...

    Hi...
    I didn't know which section to put it under...

    If, say, a lorry driver visits a customer, and asks to use their toilets, is he/she legal allowed access?

    Also what about access to facilities such as drinking water, food, etc?

    Good lord! Has someone actually stopped you using the facilities at a place you were contracted to deliver /pick up from? Knowing you are stuck in a cab for hours?
    I do not know what the legal implications are but it would be a very small minded person who would stop a lorry driver from using the loo at a drop off / collection point. Surely if you are working and are visiting the site as a supplier with a contract then there could be no legal reason for them to say you cannot use the loo. I know that during the war the women of the ATA were often refused access to the loo at the Air Bases they were delivering /collecting planes from as the facilities were for the ‘men only’. Bloody stupid.
    If they come up with some meandering insurance excuse it would be interesting to know if that would also apply if a big customer came to visit. Likewise drinking water and If it is a pay at the till canteen then why on earth would they refuse you access. Things like this make me very angry.
    Anyway, I am sure some smart beagles will come along with the right info.

        The Road Haulage Association (RHA) has waded into the debate over toilets for HGV drivers, branding firms that accept deliveries but refuse them access to facilities as appalling and hypocritical.

        The comments come as the Unite union and an offshoot of the British Toilet Association gear up to apply pressure on businesses that do not allow professional drivers the use of on-site toilets.

          I know, disgusting attitude we have to suffer sometimes... We are all humans, it's almost treating us like second class citizens sometimes...

              Oddly enough we've had a few similar threads previously, and no there is no law about use of facilities generally ( other than provision in eateries, accommodation and workplaces(for staff) )

              There used to be a law that men are allowed to pee on their back wheel at the side of the road... umm hackney carriage laws I think .... Think it's been repealed now and it's not much help if you're needing a number two.

                Well i would jump in and say yes myself due to the Business connection.

                Risk assessment

                3.—(1) Every employer shall make a suitable and sufficient assessment of—

                (a)the risks to the health and safety of his employees to which they are exposed whilst they are at work; and

                (b)the risks to the health and safety of persons not in his employment arising out of or in connection with the conduct by him of his undertaking,

                I think 3(1)(b) covers this quite nicely

                  I think this is more about using facilities that are already available for employees. I am just wondering if the driver has a right to use the facilities if he is visiting a premises on legitimate business. I.e. delivering or collecting goods.
                  Amazed by that law about being allowed to pee on the back wheel –wonder if in these days of sexual equality…mind you, if I could do that I would earn a lot more!

                    Ahh could be. Toilet facilities are part of the HSW regs ( reg 20) so that puts them squarely into health and safety requirements.

                    Employers have duties under the Health and Safety at Work etc Act 1974 to ensure so far as is reasonably practicable the health and safety at work of their employees and others who may be affected by their work activities (such as drivers). Under the Management of Health and Safety at Work Regulations 1999, where 2 or more employers share a workplace, even on a temporary basis, they must co-operate with each other to make sure they both comply with their legal duties.
