  • Alliance and Leicester Loan

    I got a loan with A & L jointly with my then boyfriend. I wish to obtain a copy of my loan agreement and a copy of the statement showing payments made. (my ex & l are not on amicable terms) How long should l give Santander to complete my request?
    My ex stopped making payments on the loan in 2008 so they came after me. Albeit l'm suffering financial hardship and pay a minimum amount. Shouldn't my ex also be responsible for this loan?
    Any advice will be greatfuly received.

    I think you will find Alliance and Leicester are no more. They were taken over by Santander in 2008

    If you sent a CCA request to Santander with the £1.00 fee they have to respond with the agreement within 14 days or it becomes unenforceable

        You need two separate letters. One would be the CCA request for a copy of your agreement, they should respond in 12+2 working days. They are only obliged to send you a statement of account, not the whole lot of statements showing all payments made into the account. For that purpose you'll need to send a SAR which costs £10 and they have 40 days to respond. In some cases banks will include a copy of the agreement with the SAR but this isn't always the case.

        With joint loans, both parties are liable to repay the whole of the loan.

          Below is a SAR letter I have used a few times:

          Dear Sirs

          Ref: xxxxxxxx

          Subject Access Request - S.7 Data Protection Act 1998


          Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or printouts of all account transactions; all internal and external correspondence sent or received by you including memos, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on all types of media in any relevant filing system. If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

          If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

          Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge. I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

          Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

          I enclose the statutory maximum fee of £10.00 to access ALL data held by you about myself. You have 40 days in which to comply with this request.

          Yours faithfully,

          It should be sent recorded delivery with a £10 cheque or PO.

            Gee thanks, that's very helpful
            I've just been into Santander to ask which address l have to send my request to and the lady I spoke to said they only kept records for 6 years?
            My ex has disappeared and I have no idea of his address. He should be held accountable but he's left me with the debt.

              Sorry to hear about your ex. :rant: :rant: :rant: It's not a fair system, you should only be liable for 50% of a joint debt but sadly that's not the way it works. :mad2: :mad2: :mad2:

              When I sent a SAR to Santander in Dec 2011 I got only six MONTHS worth of statements to start with, they said if I wanted more I should pay another £10! :scared: :scared: After sending a formal complaint I got the full six years plus £50 compensation paid into my current account :grin: :grin: :grin: but it took a few months. :ohwell: A lot of banks will say they only keep records for six years. :mmph:

              The six years only apply to the SAR response, if you took out the loan over six years ago they should still hold a copy of your agreement and if they can't provide it, then the account would be unenforceable. I took out an A&L loan in 2006 and signed an agreement in branch with all the T&Cs at the time so I'd say unless yours was substantially different, it is probably enforceable, provided they have the paperwork. :sad:
